What the Transparency in Frontier Artificial Intelligence Act Means for Older Adults in California

AI promises convenience and innovation at a scale we have never seen before. At the same time, its rapid growth brings serious concerns such as privacy, misinformation, bias, and even safety risks. California’s new Transparency in Frontier Artificial Intelligence Act (TFAIA) aims to strike a balance between these benefits and harms. By setting rules for how powerful AI systems are developed and monitored, the law seeks to ensure that innovation continues while protecting the people who rely on these tools, including older adults and their caregivers.

What Is the TFAIA (SB 53)?

At its core, TFAIA is a California state law designed to increase transparency and safety in the most advanced AI models. These are AI systems built using extremely large computational resources and developed by companies generating at least $500 million in revenue. Some key features include:

  • Public safety frameworks: AI developers covered under the law must publish on their websites how they incorporate national, international, and industry-consensus standards into their AI systems.

  • Disclosure to users: Consumers must be informed when they are interacting with AI tools, and be made aware of potential risks.

  • Incident reporting: Developers must report major safety or security incidents (e.g. cyber attacks, malfunctioning behavior) to California’s Office of Emergency Services.

  • Whistleblower protection: Employees who raise safety concerns are protected from retaliation under the law.

  • Consortium “CalCompute”: The law creates a state-backed consortium to support research into safe, ethical, equitable, and sustainable AI, including a state-run cluster of computing infrastructure.


Although the law is at the state level, it is widely seen as having potential national and global influence, since California hosts over half of the world’s leading AI companies and many tech innovators. Lawmakers in California worked closely with some of the foremost experts in AI—including Dr. Fei-Fei who is dubbed as the "godmother of AI". The state has already passed several AI-related laws to tackle harms such as deepfakes and unauthorized use of digital likenesses.

How Does This Impact Older Adults in California?


Many older adults now use voice assistants such as Alexa, Siri, and Google, along with smart home devices like thermostats, fall detectors, and medication reminders. These technologies can be helpful, but they most are or are inevitably becoming powered by artificial intelligence that often operates behind the scenes, making decisions or suggestions that may not always be clear to the user. With the new transparency requirements in California’s TFAIA, older adults and their caregivers can begin to see more clearly how these AI systems function. Companies will be required to disclose the standards and practices guiding their technology, which can make it easier to understand what data is being collected, how it is being used, and what risks may be involved. For caregivers, this added clarity may support more informed decisions about whether to trust a particular app or device in the home. The law also creates new safeguards for when things go wrong. If an AI-powered tool malfunctions and causes a major safety incident, companies must report such incidents to state authorities. Just as important, the law creates a mechanism for caregivers and older adults themselves to report incidents directly to the state. This means that when families experience harm or notice unsafe behavior from an AI tool, they can contribute to a public safety system designed to track and address those issues. Instead of complaints being ignored or hidden within companies, these reports could build pressure for improvements and provide a record of recurring problems. Whistleblower protections add another layer of security by allowing employees to raise concerns without risking their jobs, increasing the chances that unsafe or unethical practices are exposed. This could help problems come to light more quickly instead of being hidden or downplayed. By requiring AI developers to be more transparent, accountable, and equitable, the TFAIA gives caregivers and older adults more tools to protect themselves from harm and more confidence in choosing which AI systems to bring into their lives.
